Lawrence King Mistrial

It is entirely fucked up that a mistrial was declared in the Lawrence King trial. A kid brings a gun to school and shoots another, unarmed kid for being feminine, and they couldn’t come to a decision on whether it was murder or manslaughter.

Jurors told Ventura County Superior Court Judge Charles Campbell they were unable to reach a unanimous decision on the degree of Brandon McInerney’s guilt for killing 15-year-old Larry King. The nine-woman, three-man panel said they took a series of votes with the last one being seven in favor of voluntary manslaughter, while five others supported either first-degree or second-degree murder.

What complete goddamned horseshit. He threatened to kill him, and then he killed him. How on earth is that manslaughter?

DC Trans Woman Murdered: Lashay McLean

DC Trans Coalition has just reported the death of another young trans woman.

Washington, DC – In the early hours of Wednesday, July 20th, 2011, Lashay Mclean, a 23 year old transgender woman, was murdered in Northeast DC. The murder took place near the Wanda Alston House, a housing program for homeless LGBTQ youth operated by Transgender Health Empowerment (T.H.E.). Another trans woman was present during the attack and, thankfully, escaped. The Metropolitan Police Department has no leads or possible motives, and has not classified Lashay’s murder as a hate crime.

Lashay was a friend to many people in the community – including several DC Trans Coalition (DCTC) organizers who offer our sincerest condolences to those grieving this loss. We must stress once again the absolute necessity for the police and media to respect Lashay’s gender identity. The least we can do to honor her memory is to respect her chosen, lived identity.

While nothing can bring back those we have lost or undo the suffering, we can and should confront the daily terror and anxiety that trans and gender non-conforming people face. We can do this by building networks of mutual support and solidarity that sustain our efforts to feel safe and make change. Together, we must challenge the institutional racism, poverty, transphobic attitudes, lack of social services, criminalization of sex work, and other policies that jeopardize our security.

We demand that MPD make finding Lashay’s killer a top priority, lest she become a repeat of the unsolved 2009 lethal stabbing of Tyli’a “NaNa Boo” Mack in broad daylight, or the 2010 assault of Chloe Moore by an off-duty MPD officer who has not been charged in the case. “Lashay’s murder is yet another visceral reminder that transgender women are consistently placed in dangerous situations. These acts of violence are not isolated incidents. The recent findings of the DC Trans Needs Assessment show trans communities in DC have overwhelming concern for our physical safety,” said Sadie Ryanne Vashti, a DCTC organizer who knew Lashay. “Regardless of the individual motive in this case, our lives are institutionally marginalized and regarded as expendable. This makes trans women – especially women of color and those involved, or presumed to be involved, in the sex industry – far more susceptible to violence.”

We continue to hope for a future where there are no more senseless and violent deaths in our communities. Lashay’s memory will strengthen our resolve to continue surviving, supporting one another, and struggling for a better world. There will be a vigil July 23rd at 7pm on the 6100 block of Dix Street NE, the site where Lashay was killed.

Some days, working in and for the trans community is the saddest work. Love to all who knew Lashay.

Something Like Justice?

The former cop who beat Duana Johnson when she was brought into the police station has been charged and sentenced. It turns out they got him on tax evasion as well. He’ll serve two years.

What The Advocate column didn’t mention is that Johnson was shot, execution style, on the corner she normally worked not long after pressing the charges against him.

I don’t know if her murder was investigated, but this whole story has always left me feeling terrifically angry and sad because her murder looked and felt far too much like someone wanted her to keep quiet.

McDonald’s Employees

There is a petition at change.org which is calling for the McDonald’s employees who stood by, laughed, and videotaped the violent attack on a trans woman be held responsible.

I have no idea what kind of precedent that might be, but a law like this is long overdue.

Not at all ironically, it is in Maryland that a recent non-discrimination law recently went down in flames because gender identity was added to the bill and legislators, as per usual, were presented with the bullshit argument that somehow “men in dresses” would be hiding out in ladies’ room inflicting violence. THERE HAS NEVER BEEN A CASE OF THIS HAPPENING, and as we can all see here, it is transpeople who require protection and safety from transphobic bigots. The Democratic Senators who backed out of supporting the bill – even after confirming their support – should be ashamed of themselves.

What Does a Feminist President Look Like?

Oh yes: Not just Obama, but his VP Joe Biden, who in a recent interview on NPR about rapes on college campuses, said plainly:

Look, folks, rape is rape is rape.

Among the points made by the administration, are:

— When a woman brings a complaint that she was a victim of assault, a school cannot punish her for using alcohol or drugs. In most allegations of sexual assault, alcohol is involved. Laws in every state say when a woman is drunk to the point of passing out, she can’t give consent. But some women have complained that when they went to school administrators to say they’d been sexually assaulted, they ended up getting punished for breaking school rules on drinking or using drugs.

— Schools must fully inform a person who brings a complaint of her or his (men are victims in about 6 percent of assault cases, according to federal officials) rights to an investigation and then they must be told the outcome of the investigation. Some schools thought they could not tell the victim the result of an investigation because it would violate the privacy of the alleged perpetrator.

— Even if a student is said to have assaulted another student in off-campus housing, the school must investigate.

— Schools must investigate in a timely manner. Some schools told women they could not get involved until after local police completed a criminal investigation. That often left a woman on campus — and even in the same dormitory or classrooms — with the man she said had assaulted her.

I would like to see this same points used to investigate accounts of hate crimes, too.

Film about Angie Zapata

A film made about the life & death of Angie Zapata is premiering this week in Denver:

This local story is told by local filmmakers. Denver company Loco Lane Filmworks, helmed by Director Alan Dominguez, created this 1-hour documentary by speaking to Angie’s family and friends as well as showing photographs of Angie. Scored by Mackenzie Gault (of Flobots fame) and featuring a song by L.A.-based band Ozomatli, the film focuses on Andrade’s life as remembered by her family as well as the trial of her killer.

It’s called Photos of Angie.

All Out: Help Brazil Pass a Hate Crimes Law

A 22 year old woman named Priscila was murdered execution style in Brazil. Too many LGBT people in Brazil – particularly trans people – are killed. A local group, All Out, is seeking a hate crimes law to help prevent these murders, and have an online petition you can sign.

I didn’t embed the video here because it’s too triggery for too many of us who have lost people to transphobic violence. Do watch, because it’s important – and a lovely chance to see this young woman alive and optimistic about her life – but I thought people needed to ready to watch.

But there’s no connection, and you’d be a fool and a Communist to make one. There’s no connection between having a gun and shooting someone with it, and not having a gun and not shooting someone. There have been studies made and there is no connection at all there. Yes. That’s absolute proof. You know, fourteen deaths from handguns. Probably American tourists, too.

Trans Woman Attacked at Kohl’s in TN (Warning: Triggery)

It sounds like it’s going to be just some holiday shopping insanity, but then:

When store personnel unlocked the doors to the store, Akasha Adonis and her mother of Humboldt, TN made their way to one of four entrances where there was no line. As they were entering the store, a girl from another entrance where there was a line ran up to Akasha’s mother and another woman and attempted to ram through them into the store. When Akasha stepped between the girl and her mother to protect her, the girl jumped into Akasha’s face and began cussing at her. At the same moment, a man attacked Akasha and another woman at the entrance. The assailant hit Akasha and pulled out her hair as he pulled her through the door into the store. The man then shoved his hand in her mouth with his thumb, tore three of her teeth out of socket, and broke her jaw as he forced Akasha to the ground. The assailant then stood up and walked into the store to shop as Kohl’s staff stood idly by greeting other shoppers.

What the fuck is wrong with people?

On top of it, a comment made by a Kohl employees make the bias obvious, and the police, as well, have been insensitive, bigoted jackasses:

Akasha’s mother posted about the incident on her Facebook page. A Kohl’s employee posted a comment in response which read: “no it happened before I got there. i got there at 5 AM. they said it was a guy and a guy dressed up as a woman . they said the he/she/it got its wig knocked off and some teeth knocked out.”

An officer describes a broken jaw & the loss of three teeth as “no serious injuries.”
